ACCEPTANCE OF THE GENERAL CONDITIONS

This site and the utilization of it are subjected to the following general conditions, that the user may accept or not. The access to this site involves the unconditional acceptance of the following general conditions. If the user hasn't the intention to accept these conditions, he/she isn't authorized to enter this site.


ALTERATION OF THE SITE AND OF THE CONDITIONS FOR THE utilization of this site

In any moment ACMA reserves itself the right to modify the content of its site, eliminating or adding new parts. Consequently, the user accepts these general conditions in the version he/she finds in the site when he/she enters it.

Moreover, ACMA reserves itself the right to modify the terms and conditions on the basis of which the site and the services are offered. The user must charge himself/herself to regularly have a look at these terms and conditions and at the Additional Conditions present on the pages of the site. The fact that the user continues to use ACMA SPA's site and services means his/her acceptance of all specified terms and conditions.


USER'S REGISTRATION AND PROTECTION OF PERSONAL DATA

The utilization of particular pages of the site can happen only after the user's registration through the registration procedure. This one has to contain present-day, complete and thorough information, as it is requested in the concerning form. Moreover, a password can be assigned to the user in order to take advantage of the services. The user is the unique responsible for the privacy and the protection of the password. ACMA is not responsible for eventual damages due to the utilization of the user's password by another person, with or without the user's authorization.


UTILIZATION OF THE SITE AND OF THE SERVICES

The user is authorized to read, consult and make a unique copy of the materials inserted in the site, to the unique aim of consulting and/or spreading ACMA's products. Any other right and/or use is excluded.

The site and the services can contain community, personal Web pages, file archives and/or other message or communication services useful for the user's communication with other people (called “Communication Services”). The user commits himself/herself to utilize the Communication Services only in relation to suitable materials and information. Moreover, the user commits himself/herself not to divulge, send, load, distribute, spread unsuitable, profaner, slanderous, obscene, indecent, illegal names, materials and information that violate the other people's rights.

The user can't intentionally load and spread files containing virus worm, altered files or other software or similar programs, that damage others' computers, forge or cancel authors' attributions, legal communications, other suitable communications, designations concerning the rights of intellectual property or signals relating to the origin or to the source of the software or of other materials present in the site.

ACMA hasn't to verify the Communication Services. Nevertheless ACMA reserves itself the right to modify the materials transmitted to a Communication Service and to remove these materials at its mercy. ACMA reserves itself the right to stop the user's access to one or all Communication Services, at any time, without forewarning and for any reasons.


LIMITATION TO THE UTILIZATION OF THE SITE AND OF THE SERVICES

It is forbidden for the users to utilize the site and its services for illegal or prohibited purposes on the basis of the laws in force. The user can't utilize the site and the services in a way that the site or a part of it is damaged, deactivated, overloaded or prejudiced. Moreover, the user can't compromise other people's utilization and/or enjoinment of the site. The user can't try to get or enter ACMA's site and services in an unauthorised way, through means that are not intentionally put at disposal or provided through the site or by ACMA.


LINK TO OTHER SITES

This site could contain “apparent links” or links that allow the user to enter third party's Internet sites. This site is completely independent from the related sites and the sites in which it is possible to enter. These sites contain their own general conditions of utilization.

ACMA doesn't control these sites, their general conditions of utilization, and is not responsible concerning their content, their general conditions, the allowed use and the treatment of the user's information and data.


NO UTILIZING THE MATERIALS PRESENT IN THE SITE

It's prohibited to change, reproduce, modify, display, utilize the materials of this site (photographs, illustrations, texts, video clip, etc.) on other sites, also for commercial purposes. It is only possible with ACMA's written authorization in order to identify and promote ACMA's products.


ACMA SPA BRANDS

All the rights concerning the elements present in this site, such as information, software, logos, texts, photographs, images, graphs and any other elements are exclusively reserved for ACMA.

The brands (and the other distinctive signs) present in the site are registered under the name ACMA, or however they belong, directly or indirectly, to ACMA and/or to the controlled or joined companies. It is prohibited their reproduction and utilization, except after ACMA's not transferable licence concession, to the unique aim of promoting and selling ACMA's products.

The user expressly recognizes all ACMA's rights relating to ACMA brand and to the ACMA Group's other brands (Brands).

Moreover, the user is aware of the fact that entering this site he/she doesn't acquire neither the rights concerning the brands nor any starting. The user undertakes not to have at his/her disposal, directly or by means of an intermediary, on behalf of a third party, individuals and/or corporate bodies, the brands of this site.


LIMITATION OF RESPONSIBILITY FOR THE SITE CONTENTS

ACMA declines any responsibilities about the consequences deriving from the possible malfunctioning of the site and/or for the damages or the lost of profits that can occur either to the user or to the third party. The use of the services is completely at the user's risk. The services are available without any guarantees, either explicit or implicit. The content of this site is at disposal at the present condition, without any express or implicit warranties concerning its quality and adaptability to a particular use. ACMA doesn't assure that this site will never be interrupted or that it contains mistakes. In no case ACMA answers for eventual inquiries about compensation for damages by the user of this site.

ACMA doesn't assure neither the accuracy nor the reliability of the content of this site.


PROTECTION OF PERSONAL DATA

All the information that the user transmits to this site will be treated on the basis of the rules established by the D.LGS. n. 196 of 30 June 2003 and will be included in a particular system in order to avoid the access to these data by a third party. In this site the user has the opportunity to contact ACMA on line, in the case he/she wants to send his/her Curriculum Vitae, to ask questions concerning ACMA's present and future products and/or services, in other words to suggest.

The user's CV will be utilized only in relation to the needs of personnel engaging and the personal data will not be utilized and/or spread, except with the user's written consent.

At any time the user can request to enter, modify or cancel his/her personal data in the archives.

ACMA assures that the personal information containing sensitive data (such as the information concerning the user's Curriculum Vitae), after the receiving of an explicit written consent, will be considered as confidential information, on the basis of what is established by the D.LGS. n. 196 of 30 June 2003.

The user states that he/she will not bring an action against ACMA for the utilization of his/her information and will keep ACMA undamaged for any third party's claims relating to these information.


RECEDING

The user has the right to recede at any time since the registration service, informing ACMA through the suitable section. In 76 hours since the user's receding communication, ACMA will disable the access to the services.


ADDITIONAL CONDITIONS

The user is informed that some services of the site could be subjected to additional conditions. These additional conditions concerning the single services are available in the pages of the site dedicated to them. In case of conflict among these general terms and conditions and the additional conditions or other conditions present in the site, will prevail the additional ones.


APPLICABLE LAW AND COMPETENT COURT

These terms and conditions are regulated by the Italian law. If something is not expressly indicated in this document, is applied the Italian law. For any controversies that could occur about the interpretation, the execution and the validity of these terms and conditions, will be exceptionally competent the court of Milan.
